1. About SJY Art Designs

SJY Art Designs creates handcrafted artwork using materials such as glass mosaic tile, brushed metal, and graphite stone. Many pieces are one of a kind, and custom work may also be available upon request.

We reserve the right to update, change, or modify these Terms and Conditions at any time. Any changes will take effect once posted on this website.

 

2. Use of This Website

By using this website, you agree that you will use it only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use of the site.

You may not misuse this website, attempt to gain unauthorized access to any part of it, or use any content from the site without permission.

 

3. Product Information

We make every effort to display our artwork as accurately as possible, including colors, textures, dimensions, and materials. Because each piece is handcrafted and viewed on different screens, slight variations in appearance may occur.

These natural differences are part of the character of handmade artwork and are not considered defects.

All sizes, descriptions, and specifications are provided as accurately as possible, but slight variations may occur.

 

4. One of a Kind Artwork

Many pieces sold by SJY Art Designs are original, one of one works. Once a one of a kind piece has been sold, it may not be available again.

Adding an item to your cart does not reserve it. A piece is only considered sold once payment has been completed and the order has been accepted.

We reserve the right to cancel an order if a piece becomes unavailable due to an inventory error, damage, or other issue. If this happens, any payment made will be refunded in full.

 

5. Custom Orders

SJY Art Designs may accept custom orders based on availability and project scope. Custom orders may include requested variations in color, size, style, or related design preferences.

For custom work, additional terms may apply, including estimated production timelines, design approval, deposits, and final payment requirements.

Unless otherwise stated in writing, custom orders are final sale and are not refundable once work has begun or materials have been purchased.

SJY Art Designs reserves the right to decline any custom request at its sole discretion.

 

6. Pricing and Payment

All prices are listed in Canadian Dollars (CAD). Prices are subject to change without notice.

Payment must be received in full before an order is processed, unless a separate written agreement applies to a custom order.

You agree to provide current, complete, and accurate billing and payment information at the time of purchase.

If a payment is declined or cannot be processed, we may cancel or delay the order.

 

7. Order Acceptance and Cancellation

After you place an order, you may receive an order confirmation. This confirmation does not guarantee acceptance of the order.

We reserve the right to refuse or cancel any order for reasons including product availability, pricing errors, suspected fraud, or incorrect billing or shipping information.

If your order is canceled after payment has been received, you will be refunded the amount paid.

 

8. Shipping and Delivery

We will make reasonable efforts to process and ship orders within the estimated timeframe provided on the website or at the time of purchase. Shipping times are estimates only and are not guaranteed.

SJY Art Designs is not responsible for delays caused by carriers, weather, customs, supply issues, or events outside our control.

Customers are responsible for providing an accurate shipping address. We are not responsible for delays, losses, or extra costs resulting from incorrect shipping information provided by the customer.

Risk of loss or damage passes to the customer upon delivery to the shipping address provided at checkout.

 

9. Local Pickup

If local pickup is offered, pickup instructions will be provided after purchase. Customers are responsible for collecting the artwork within a reasonable time.

Valid identification may be required at pickup.

 

10. Returns and Refunds

Due to the handmade and often one of a kind nature of our work, all sales are considered final unless otherwise stated.

We do not accept returns or offer refunds for change of mind, personal preference, or minor variations in color, texture, or finish that are consistent with handcrafted artwork.

If your order arrives damaged, you must contact us within 2 days of delivery at scott@sjyartdesigns.com and include your order number, photos of the item, the packaging, and any visible damage.

If we determine that the item was damaged in transit or that the wrong item was sent, we may offer a replacement, repair, store credit, or refund at our discretion.

Custom orders are non refundable once production has started, unless required by law.

 

11. Damaged or Lost Shipments

If your package arrives visibly damaged, please keep all packaging materials and take photos immediately.

If a shipment is lost, delayed, or damaged in transit, we will work with the shipping carrier to assist where possible. However, resolution may depend on the carrier’s claims process.

 

12. Intellectual Property

All content on this website, including artwork, images, logos, text, graphics, product descriptions, and branding, is the property of SJY Art Designs and is protected by applicable intellectual property laws.

The purchase of artwork does not transfer copyright or reproduction rights unless expressly agreed in writing.

You may not copy, reproduce, distribute, publish, modify, or use any artwork or website content for commercial purposes without prior written permission.

 

13. Artistic Rights

SJY Art Designs retains all rights to images and reproductions of the artwork unless otherwise agreed in writing.

We may photograph and display sold or commissioned work for portfolio, website, social media, and promotional purposes unless a written agreement states otherwise.

 

14. Third Party Services

This website may use third party platforms or services for payment processing, shipping, analytics, or website functionality. We are not responsible for the policies, actions, or service interruptions of third party providers.

Your use of those services may also be subject to their own terms and policies.

 

15. Disclaimer

This website and all products and services are provided on an as available basis and as described.

While we strive for accuracy, we do not guarantee that the website will always be uninterrupted, error free, secure, or fully up to date.

To the fullest extent permitted by law, SJY Art Designs disclaims all warranties, express or implied, except those that cannot be excluded by law.

16. Limitation of Liability

 

To the fullest extent permitted by law, SJY Art Designs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website, your purchase of artwork, or your inability to use our products or services.

Our total liability for any claim related to a purchase shall not exceed the amount paid by you for the item giving rise to the claim.

You agree to indemnify and hold harmless SJY Art Designs from any claims, damages, liabilities, costs, and expenses arising out of your misuse of the website, your breach of these Terms and Conditions, or your violation of any law or the rights of a third party.
